Marketplace terms

Introduction

These are the marketplace terms you agree to when you take shifts through Shiftly. They cover your working relationship, how rates are set, how and when you are paid, tax and invoicing, cancellations and disputes.

You accept these terms in the app, and we record which version you accepted and when. If we change them in a way that matters, we will ask you to accept them again. These terms sit alongside our conduct and safety code and our community guidelines.

Shiftly is a marketplace. We connect venues with workers and handle the booking, the payment and the paperwork around it. We are not your employer, and we are not a labour hire agency. Read these terms together with our privacy policy.

Your working relationship

  • You work for yourself as an independent contractor. You are not an employee of Shiftly, and you are not an employee of the venue.
  • You choose which shifts to apply for. Nobody assigns work to you and you are not required to accept anything.
  • You provide your own ABN. You are responsible for your own tax affairs.
  • You are responsible for holding the licences and credentials the roles you take require.

Because you are a contractor, some things that come with employment do not apply, including paid leave and unfair dismissal protections. Your entitlement to superannuation is dealt with below.

Rates and what you are paid

  • Every shift shows the rate before you apply. You are never asked to bid against other workers on price.
  • Rates are set at or above the relevant modern award minimum for the role, the time of day and the day of the week.
  • Superannuation is paid on top of your shift earnings at the current legislated rate.
  • Shiftly charges a platform fee. The fee is disclosed in the earnings breakdown for the shift before you apply, so the amount you see is the amount you get.

The award used, the rate breakdown and the fees for a shift are shown in the app and are fixed at the time you are booked. They do not change afterwards without a dispute being raised and resolved.

Getting paid

  • You clock in and clock out through the app. Those times are the record of what you worked.
  • After the shift the venue has a short window to review the timesheet. If they do not act within it, the timesheet is approved automatically.
  • Once approved, your payment is released to the bank account on your Shiftly profile.
  • If a dispute is raised on a shift, payment for that shift is held until the dispute is resolved.

Tax and invoicing

  • You need a valid ABN to be paid through Shiftly.
  • If you are registered for GST, Shiftly raises recipient created tax invoices (RCTIs) on your behalf, and you agree to us doing so. You must tell us if your GST registration changes.
  • If you are not registered for GST, no GST is added and no RCTI is raised.
  • Your records are available in the app so you can give them to your accountant or the ATO.

Cancellations and no-shows

  • If you cannot work a shift you have accepted, cancel in the app as early as you can so the venue can find cover.
  • Late cancellations and no-shows affect your reliability score, which venues can see.
  • If a venue cancels a shift you were booked for, you are notified immediately.
  • If something outside your control stopped you working, raise it in the app with any evidence you have and we will assess it.

Working outside Shiftly

You are free to work wherever you like. What is not allowed is using Shiftly to find a venue and then arranging the same work off the platform to avoid fees. We monitor for it, and it can cost you access to Shiftly.

Disputes

  • If your pay or hours are wrong, raise a pay dispute on the shift in the app.
  • Safety and conduct concerns are raised separately and never affect what you are paid.
  • We review the evidence from both sides, including your clock-in and clock-out and any files attached, and record the decision and its reason.
  • Where a dispute changes what is owed, we adjust the payment and show you the corrected breakdown.

Ending your account

You can delete your account from account settings in the app at any time. We keep the records we are legally required to keep, including tax and payment records, for as long as the law requires. Our privacy policy explains what is kept and for how long.

We can suspend or close an account that breaches these terms, the conduct and safety code, or the community guidelines.
